Overview of the protection of minors The purpose of the
protection of minors and their binding regulations should be
the protection of children and young people from contents
which may impair or jeopardize them in their development or
education. This is read in more detail in § 1 JMStV: "The
purpose of the State Treaty is to ensure uniform protection
of children and adolescents from information contained in
electronic information and communication media which may
impair or endanger their development or education, and to
protect them from such information in electronic information
and communication media that promote human dignity or
otherwise through the Penal Code infringe protected rights.
" When it comes to the question as to which contents
„impair„ or „jeopardize", the JMStV specifies a three-level
system in § 4 and § 5. There is a distinction between
„absolutely inadmissible offers„, „relatively inadmissible
content„ and „development-impairing offers„. |
